1. Introduction

The Occasionist and The Occasionist Studio (collectively referred to as “The Occasionist”) bring together bespoke travel design and intelligent technology. We curate, connect, and craft meaningful journeys, combining human expertise with AI-assisted tools that simplify and elevate the travel-planning process.

Our services include the curation, mediation, and arrangement of accommodations, transportation, activities, and related services, as well as the operation of digital platforms such as The Occasionist Studio, which enable clients to explore, personalize, and manage travel proposals through conversational and AI-assisted interfaces.

Unless explicitly stated otherwise, The Occasionist acts as an intermediary between clients and trusted local partners who are responsible for the organization and execution of travel services. In select cases, The Occasionist may itself act as the contracting travel organizer.

These Terms of Service set out the conditions governing the use of all services, websites, and digital platforms operated by The Occasionist. By accessing or using any of these services, you acknowledge that you have read, understood, and agreed to be bound by these Terms.

2. Bookings and Payments

The Occasionist provides quotations for curated travel experiences and services upon request or through the The Occasionist Studio platform. These quotations include all costs related to our planning, handling, and coordination services and are based on current exchange rates, supplier prices, and applicable taxes.

All quotations are provided for informational purposes only and are subject to change without prior notice until the booking is confirmed. Once you have confirmed that you would like to proceed, The Occasionist will issue a formal reservation request with the expected final price.

We strive to ensure the accuracy of all reservation details; however, availability, pricing, and included services are not guaranteed until the booking has been confirmed by all relevant partners. Prices are quoted in the currency specified in your offer, and minor variations may occur due to changes in exchange rates or supplier costs prior to final confirmation.

To confirm your booking, a deposit of typically 40% of the total trip cost is required within 10 days after receiving the reservation request, unless otherwise specified in your individual offer. The remaining balance is due 90 days prior to the start date of your trip.

The Occasionist accepts payments by major credit cards (Visa, Mastercard, American Express), secure digital payment methods through Stripe, and traditional bank transfers. Where offered, payments in other currencies or via alternative methods (including major cryptocurrencies) may be accepted at The Occasionist’s discretion.

Please note that transaction fees, bank charges, or currency conversion costs associated with the chosen payment method are the responsibility of the client, unless otherwise stated in the booking documentation.

All payments must be received in cleared funds within the stated deadlines to confirm or maintain a booking. The Occasionist reserves the right to cancel any booking if payments are not received on time.

3. Cancellations and Changes

We understand that plans may change. In the event of a cancellation or change of travel dates, The Occasionist will make every reasonable effort to assist you in rescheduling or minimizing any associated costs.

Please note that deposits and certain supplier payments are typically non-refundable once confirmed. However, whenever possible, The Occasionist will seek to refund your paid deposits or retain them as travel credit, which may be applied toward future trips booked through The Occasionist.

Requests to postpone or modify travel dates are subject to the availability and policies of our local partners. While we will make every effort to accommodate your new dates, such changes may, in some cases, be treated as a cancellation and rebooking under the supplier’s terms.

Our team will work closely with you to identify the best possible solution and to make any necessary arrangements in line with the conditions set by our travel partners.

4. Supplier Terms and Conditions

Certain elements of your trip may be subject to the specific terms and conditions of our local partners or service providers. Where such supplier terms apply, they shall take precedence for that component of the journey and will be shared with you prior to booking.

5. Insurance

While travel insurance is not mandatory for booking a trip with The Occasionist, we strongly recommend obtaining comprehensive coverage to protect yourself and your investment.

Travel insurance can provide protection against unforeseen events such as trip cancellations, delays, medical emergencies, lost luggage, or other circumstances that may disrupt your travel plans. Having adequate insurance offers peace of mind and financial security throughout your journey.

We advise you to carefully review different insurance options and select a policy suited to your specific needs. If desired, The Occasionist can provide general guidance or recommendations regarding reputable insurance providers, though any purchase or claim must be arranged directly between you and the insurance company.

6. Travel Documents and Visa Requirements

It is the traveler’s responsibility to ensure that all required travel documents, such as valid passports, visas, entry permits, and health certifications, are obtained prior to departure. Passports should generally be valid for at least six months beyond the intended return date and contain sufficient blank pages for required entry and exit stamps.

The Occasionist can provide guidance and general assistance regarding visa requirements and application procedures but does not assume responsibility for obtaining visas or other travel documents unless explicitly stated in your individual booking agreement.

Travelers are responsible for ensuring the accuracy of all personal information provided during the booking process and for reviewing any travel documents issued as part of the confirmed arrangements. The Occasionist cannot be held liable for any travel disruptions, denied boarding, or entry refusals resulting from inaccurate or incomplete information.

7. Health Requirements and Certificates

The Occasionist will provide information, to the best of its knowledge, regarding any known health or vaccination requirements for your chosen destination(s).

It is the traveler’s responsibility to obtain, verify, and comply with any mandatory or recommended health measures, such as vaccinations, medical certificates, or entry-related health documentation. The Occasionist cannot be held responsible for any issues, delays, or disruptions arising from non-compliance with such regulations.

Upon request and with your explicit consent, The Occasionist may liaise with your healthcare provider to share destination-related information and facilitate a comprehensive pre-travel consultation.

8. Platform Use and Conduct

Users of The Occasionist Studio are responsible for maintaining the confidentiality of their account credentials and for ensuring that all information provided within the platform is accurate and up to date. Any actions taken through a user account are deemed to have been made by the account holder.

The Occasionist grants users a limited, non-exclusive, non-transferable right to access and use the platform and its content solely for personal, non-commercial purposes related to the planning and booking of travel experiences.

Users agree not to misuse the platform in any way, including but not limited to:

  • attempting to gain unauthorized access to systems or data;
  • using automated systems, bots, or scripts to extract data;
  • uploading or transmitting malicious code;
  • engaging in conduct that disrupts the operation of the platform or affects the experience of other users.

The Occasionist reserves the right to restrict, suspend, or terminate access to the platform or user accounts in cases of misuse, violation of these Terms, conduct deemed detrimental to the integrity of the platform or the brand, or in situations involving abusive, threatening, or otherwise inappropriate behavior toward staff, partners, or other users.

9. Accuracy of Information and Images

The Occasionist strives to ensure that all information presented on its websites, platforms, and communications, including trip descriptions, itineraries, prices, and editorial content, is accurate and up to date. Nevertheless, occasional inaccuracies, typographical errors, or changes to services and availability may occur. The Occasionist reserves the right to correct such information at any time without prior notice.

All images and visual materials used by The Occasionist, including AI-generated or illustrative imagery, are provided for inspirational and representational purposes only. They are intended to convey the style, mood, and atmosphere of a destination or experience, and may not depict exact locations, accommodations, or services included in a particular itinerary.

The Occasionist cannot be held responsible for discrepancies between illustrative materials and actual on-site conditions or third-party services.

10. AI Assistance and Automated Communication

The Occasionist Studio uses artificial intelligence ("AI") systems to assist users in discovering and refining travel ideas. These systems generate suggestions and content based on user input and available data.

AI-generated information is intended solely for inspirational and informational purposes and does not constitute verified travel advice, contractual terms, or professional recommendations. The Occasionist makes no representations or warranties as to the accuracy, completeness, or reliability of AI-generated content and encourages users to verify any information before relying on it.

Users acknowledge that some interactions within the platform may be automated. While The Occasionist continuously monitors and improves these systems, occasional inaccuracies, omissions, or tone inconsistencies may occur. The Occasionist cannot be held responsible for any misunderstanding, offense, or decision arising from automated responses.

11. Third-Party Links & External Services

The Occasionist websites and communications may contain links to third-party websites or services for convenience or reference. The Occasionist has no control over, and assumes no responsibility for, the content, privacy practices, or accuracy of such external sites or services. Accessing third-party links is at the user’s own discretion and risk.

12. Limitation of Liability

The Occasionist acts as an intermediary between clients and independent travel service providers. While we take great care in selecting our partners and coordinating arrangements, The Occasionist cannot guarantee the availability, accuracy, or quality of third-party services, nor can we eliminate the inherent risks associated with travel.

Any bookings, activities, or services arranged through The Occasionist are undertaken at the traveler’s own risk. The Occasionist is not responsible for acts, errors, omissions, or negligence of third-party suppliers, including but not limited to accommodations, guides, transportation providers, or local operators.

To the extent permitted by law, The Occasionist shall not be liable for any indirect, incidental, or consequential damages arising out of or in connection with the use of our services. This includes, without limitation, loss of enjoyment, loss of profits, property damage, theft, personal loss, injury, illness, or death.

The Occasionist shall not be held liable for any damages, losses, delays, cancellations, or inconveniences caused by factors beyond its reasonable control, such as weather conditions, natural disasters, civil unrest, strikes, political instability, force majeure events, or other circumstances inherent to travel.

Travelers are responsible for obtaining and maintaining adequate insurance to protect against potential risks, including property damage, theft, injury, illness, or death.

If The Occasionist is found liable for any claim, our total liability shall be limited to the amount paid by the traveler for the relevant services, except where mandatory legal provisions provide otherwise.

13. Intellectual Property

All intellectual property rights related to the content, design, and functionality of The Occasionist and The Occasionist Studio, including, but not limited to, text, images, graphics, videos, layouts, databases, software, and code, are owned or duly licensed by The Occasionist GmbH.

These rights encompass trademarks, logos, trade names, service marks, copyrighted materials, and proprietary information.

Any reproduction, modification, distribution, or other unauthorized use of this material is strictly prohibited. The Occasionist reserves all rights not expressly granted in these Terms of Service.

14. Privacy and Data Protection

The Occasionist respects your privacy and is committed to protecting your personal information. The collection and processing of personal data are carried out in accordance with applicable data protection laws.

Please refer to our Privacy Policy for details on how we collect, use, and safeguard your information. By using our services, you acknowledge and agree to such processing in accordance with that policy.

Users may request deletion of their account or personal data at any time by contacting info@theoccasionist.ch. Such requests will be handled in accordance with our Privacy Policy and applicable legal requirements. Certain data may be retained as required for legitimate business purposes or to comply with legal obligations.

15. Marketing Communication

By submitting an inquiry, creating an account, or otherwise engaging with The Occasionist, you consent to receiving relevant communications about your booking, trip proposals, or similar curated travel experiences.

You may unsubscribe from promotional emails at any time by following the instructions provided in each message or by contacting us directly.

16. Severability

If any provision of these Terms of Service is found to be invalid, illegal, or unenforceable, such provision shall be modified or interpreted to the extent necessary to make it valid, legal, and enforceable.

The invalidity or unenforceability of any individual provision shall not affect the validity or enforceability of the remaining provisions, which shall remain in full force and effect.

17. Applicable Law and Jurisdiction

These Terms of Service and any disputes arising out of or in connection with them shall be governed exclusively by Swiss law, to the exclusion of its conflict-of-law rules.

For any claims brought against The Occasionist, the exclusive place of jurisdiction shall be Zurich, Switzerland. The Occasionist, however, reserves the right to initiate legal proceedings against the client at their place of residence or domicile.

18. Language Precedence Clause

These Terms of Service may be provided in multiple languages for convenience. In the event of any discrepancies or inconsistencies between versions, the English version shall prevail.
